Terms of Service
Shaper Assistant (shaperassistant.com) Effective date: October 6, 2026
These Terms are a contract between you and Christopher Kontoes ("we", "us"). By creating an account or using Shaper Assistant (the "Service"), you agree to them. If you don't agree, please don't use the Service.
1. What the Service is
Shaper Assistant is a web tool for designing surfboards: outlines, rocker, foil, fins and volume, and for choosing and placing a foam blank. It produces numbers, drawings and suggestions. It does not shape boards, and it cannot see the foam in front of you.
2. Design guidance only — verify before you cut
Everything the Service shows you is guidance. Blank dimensions come from manufacturers' published catalogs and real blanks vary in production. Rocker, thickness and fit calculations are interpolated between a handful of measured points.
You are responsible for checking every dimension against the actual blank before you cut, plane or glass anything. We are not responsible for a ruined blank, a board that doesn't come out as planned, or a board that doesn't ride the way you hoped.
3. Early access
The Service is new and may change, break, lose data or go offline while we improve it. Features may be added, changed or removed at any time. Back up designs you care about by exporting them.
4. Your account
- You need an account to save designs. Accounts are managed by Clerk, our login provider.
- Keep your login private. You are responsible for what happens under your account.
- You must be at least 16 years old to use the Service.
- One person per account. Don't share accounts or resell access.
5. Your designs
You own them. You own the board designs you create. By saving them in the Service you give us permission to store, display and process them so the Service can work for you. We won't sell your designs.
Free accounts: designs are public. Designs saved on a free account are visible to anyone using the Service, along with your display name. By saving a design on a free account you give other users permission to view it and to make their own copy of it for their own use. You keep ownership; they may not claim your design as their own or sell it as a design. Copies that others have already made stay with them even if you later delete or make private the original.
Paid accounts: designs are private. Designs saved on a paid plan are visible only to you unless you choose to share them. If you upgrade, your existing designs become private at that moment; copies others made before then are not affected. If a paid plan ends, your designs become public again, and we'll warn you before that happens.
Don't save what you can't share. If a design belongs to someone else, or you're bound to keep it confidential, don't save it on a free account.
6. What's ours
The Service itself — its code, design, text, graphics, the organized blank library, and the Shaper Assistant name — belongs to us or our licensors. You may use it through the Service; you may not copy it, resell it or build a competing product from it.
Manufacturer names (US Blanks, Arctic Foam, Marko Foam and others) are trademarks of their owners and are used only to identify their blanks.
7. Acceptable use
Don't:
- scrape, crawl, bulk-download or otherwise extract the blank library or other content, by hand or by script;
- reverse engineer the Service or probe it for weaknesses;
- upload anything illegal, infringing or malicious;
- interfere with other users or with the Service's operation;
- use the Service in a way that breaks the law.
We can suspend or close accounts that break these rules.
8. Paid plans
Some features may require a paid plan. When they do:
- prices and what's included are shown before you pay;
- payments are handled by our payment provider, and you agree to their terms too;
- subscriptions renew automatically until cancelled; you can cancel any time and keep access until the end of the paid period;
- except where the law requires otherwise, payments are not refundable.
We may change prices with at least 30 days' notice before your next renewal.
9. Ending things
You can close your account at any time from your account settings or by emailing us. We can suspend or close accounts that violate these Terms, and we can discontinue the Service with reasonable notice. Sections 2, 5, 6, 10, 11 and 12 survive any ending.
10. No warranty
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and accuracy of results. We don't promise it will be error-free, uninterrupted or secure.
11. Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential damages, or for lost profits, lost data, wasted materials or lost boards, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or $50 if you paid nothing.
Some places don't allow these limits; in that case they apply as far as the law permits.
12. Indemnity
If someone brings a claim against us because of your designs, your content or your breach of these Terms, you agree to cover our reasonable costs of dealing with it.
13. Changes to these Terms
We may update these Terms. For meaningful changes we'll post a notice in the Service or email you at least 14 days before they take effect. Using the Service after that means you accept the new Terms.
14. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Disputes will be handled in the state or federal courts located in San Diego County, California, and you consent to that jurisdiction.
